Illinois security deposit law

45 days to return the deposit; cap no statutory cap.

For buildings with 5 or more units, the landlord must give an itemized statement of deductions within 30 days and return the balance within 45 days. With no deductions, the deposit is due within 45 days.

What this means for you: The strongest deposit protections apply to larger buildings (5+ units). Smaller buildings rely more on the lease and common law.

Your next step: Give a forwarding address in writing. If the deadline passes, send a demand letter; Chicago tenants have additional remedies under the RLTO.
